Abstract

With the development of globalization and the increasing role of competition in the economy, the issue of transferring state functions to a competitive environment and strengthening local self-government has become central to the agenda of many countries.
In Kazakhstan, this issue is relevant, given the country’s desire to modernize and optimize public administration. The article deals with the actual problems of modernization of the public administration system in the Republic of Kazakhstan. The main attention is paid to the analysis of the practice of transferring the functions of state bodies to a competitive environment, as well as their delegation to selfregulating organizations and local self-government bodies. The author highlights the key contradictions that arise in the law enforcement practice of the Government of the Republic of Kazakhstan during the practical implementation of the announced reforms, including the
absence of self-regulating organizations in the adopted regulatory legal acts, the observed trend of adoption in many laws in the articles on the competence (powers) of the relevant state bodies of paragraphs expanding these powers, and significantly, as well as the growth in the number of organizations with state participation. The article presents specific recommendations for optimizing the process of transfer of functions, including the introduction of the concept of «state outsourcing», strengthening anti-corruption mechanisms, conducting comprehensive studies of the transfer of functions that will identify the advantages and risks of such a transition, as well as identify problems with its practical implementation and integration, as well as strengthening local self-government.
